These terms cover this pre-launch website only. The AICON app will have its own terms.
1. Who we are
This website is operated by AICON Interactive, Inc., a Delaware corporation ("AICON", "we", "us"). By using the site, joining the waitlist or sending an athlete invite request, you agree to these terms.
2. Who can use this site
The site is for adults. You must be 18 or older to join the waitlist or send a request. If you are under 18, please ask a parent or guardian to sign up for you.
3. The waitlist
Joining the waitlist is free and does not guarantee access to the app, a launch date, a price or any feature. Product descriptions on this site are previews of work in progress and may change.
4. Athlete and trainer requests
Sending a request does not create a partnership, a license or an obligation on either side. Any partnership is set out only in a separate written agreement signed by you and AICON. Please send only information you have the right to share.
5. Our content
The AICON name, logo, site design, text, graphics and software belong to AICON or its licensors. You may view the site for personal use. You may not copy, scrape or reuse it for commercial purposes without our written permission.
6. Acceptable use
- Don't submit false information or sign up someone else without their permission.
- Don't interfere with the site, probe it for weaknesses or use automated tools to collect data from it.
- Don't use the site for anything unlawful.
7. Workout plans and training content
Informational only. The workout plan generator, the demo coach and all training content on this site are general information provided for educational purposes. They are not medical advice, not individualized coaching and not a substitute for a doctor, athletic trainer or qualified coach who knows your child. Plans are generated automatically from the age, sport and skill level you enter and are not reviewed by a person. Talk to your child's doctor before starting any exercise program.
Parental responsibility. You confirm that you are the parent or legal guardian of any child who uses a plan or content from this site, that you agree to these terms for yourself and on behalf of that child, and that you are responsible for deciding whether an activity is appropriate for your child and for supervising it.
Train at your own risk. Physical exercise carries inherent risks, including serious injury. You and your child voluntarily assume all risks of using any plan or content from this site, and your child trains at their own risk and yours. Stop any exercise that causes pain, dizziness or discomfort.
Release. To the fullest extent the law allows, you release AICON and its officers, directors, employees, contractors, licensors and partner athletes and trainers from all claims, liabilities and damages of any kind arising from or related to your or your child's use of any plan or content from this site, on your own behalf and on behalf of your child.
Hold harmless. You agree to indemnify, defend and hold AICON and the parties listed above harmless from any claim, loss or expense, including reasonable attorneys' fees, arising from your or your child's use of the site or its content, or from your breach of these terms.
No endorsement. If you enter an athlete's name, the plan you receive is general training for your child's age and sport. It is not created, approved or endorsed by that athlete.
8. Privacy
Our Privacy Policy explains what we collect through the site and how we use it.
9. Links to other sites
The site may link to websites and services we don't operate. We aren't responsible for their content or practices, and your use of them is governed by their own terms.
10. Disclaimers
The site is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows.
11. Limit of liability
To the fullest extent the law allows, AICON disclaims all liability arising from your or your child's use of the site, the workout plan generator, the demo coach or any content on the site, including liability for personal injury and for direct, indirect, incidental, special, consequential or punitive damages, under any legal theory. Where the law does not allow liability to be fully excluded, our total liability for all claims is limited to US $100.
12. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida.
13. Severability and entire agreement
If any part of these terms is found unenforceable, the rest stays in effect. These terms and our Privacy Policy are the entire agreement between you and AICON about the site. If we don't enforce a provision right away, we haven't waived it.
14. Changes
We may update these terms. We'll post the new version here with a new effective date. Using the site after a change means you accept the updated terms.
